Service Terms an Conditions

These Terms and Conditions apply to the services provided by Offroad Motorcycle Adventures Portugal (the “Company”) and govern your participation in our off-road tours. By booking and participating in our tours, you agree to these Terms and Conditions.

1. Booking and Payments

1.1. To confirm your booking, a €200 booking confirmation fee per rider is required.
1.2. The booking confirmation fee must be paid at the time of booking, either online or by phone. Until this fee is received, your reservation is not guaranteed.
1.3. Full payment for the tour (including any additional options, such as hotel accommodation or airport transfers) can be made:

  • At the time of booking, or

  • Settle the remaining balance 2 weeks before or on the tour day.

1.4. Failure to complete payment within the specified timeframe may result in cancellation of your booking.

2. Cancellation Policy

2.1. Cancellations made at least 15 days before the tour start date will receive a full refund of the booking confirmation fee and any additional payments made.

2.2. Cancellations made less than 15 days before the tour start date will result in the forfeiture of the booking confirmation fee. At our discretion, this fee may be applied toward a future booking.

2.3. For cancellations made less than 15 days before the tour start date, any additional payments beyond the booking confirmation fee will only be refunded at the Company's discretion. If agreed, these payments may also be applied toward a future booking.

3. Security Deposit

3.1. The €200 booking confirmation fee will be retained as a security deposit for potential damages to the motorcycle during the tour.
3.2. If no damages are incurred, the security deposit will be refunded in full within 5 working days after the tour concludes.
3.3. In the event of damages to the motorcycle or provided gear caused by misuse or negligence, the cost of repairs will be deducted from the security deposit. If the damages exceed €200, the participant will be responsible for covering the additional costs.

4. Rider Requirements

4.1. Participants must hold a valid motorcycle license (compatible with EU standards) and present it prior to the start of the tour.
4.2. Riders must have prior experience operating motorcycles and be confident in handling off-road terrain.
4.3. Participants must be in good physical and mental condition to participate in the tour. The Company reserves the right to deny participation if safety is a concern.

5. Included and Not Included in the Tour

5.1. Included: Use of a motorcycle with 3rd party insurance, riding gear, guided tour, and lunch during the tour.
5.2. Not Included: Travel to Portugal, fuel (motorcycles are provided with a full tank, but participants are responsible for refueling during and at the end of the tour), health insurance, accommodation (unless selected as an option), and airport transfers (unless selected as an option).

6. Insurance

6.1. Participants are responsible for securing comprehensive travel insurance that covers off-road motorcycling, including accidents, injuries, and repatriation if necessary.
6.2. EU citizens should bring their European Health Insurance Card (EHIC), and UK citizens should bring their Global Health Insurance Card (GHIC). Note that these cards do not replace the need for comprehensive travel insurance.

7. Safety and Conduct

7.1. Riders must wear all provided safety gear during the tour.
7.2. Participants must follow the instructions of the tour guide at all times to ensure the safety of the group.
7.3. Riding under the influence of alcohol, drugs, or any substances that impair judgment is strictly prohibited.
7.4. Disrespectful behaviour toward guides, other participants, or the local community will not be tolerated and may result in immediate removal from the tour without a refund.

8. Weather and Tour Modifications

8.1. Tours will proceed in most weather conditions; however, in cases of severe or unsafe weather, the Company reserves the right to reschedule or cancel the tour.
8.2. If a tour is cancelled due to weather, participants may reschedule or receive a full refund.

9. Liability

9.1. The Company is committed to providing a safe and enjoyable experience; however, participants acknowledge that off-road motorcycling carries inherent risks.
9.2. The Company is not liable for any injuries, accidents, or losses incurred during the tour, except in cases of gross negligence.
9.3. Participants are responsible for any damage caused to third-party property during the tour.

10. Governing Law

10.1. These Terms and Conditions are governed by the laws of Portugal.
10.2. Any disputes arising from the tour or these terms will be subject to the exclusive jurisdiction of Portuguese courts.
